1. Acceptance of Terms

These Terms of Use (“Agreement”) establish a legally binding relationship between you (“User”) and Safe Kids Strong Moms (“Company,” “we,” “us,” or “our”) regarding your access to and use of our website and related services, including but not limited to the EMF Awareness Kit, the 18-Day EMF Home Reset Program, EMR Smart Kids, and Faraday EMF Shield Bags (collectively, the “Site” and “Services”).

By accessing the Site, purchasing a product, or creating an account, you agree to be bound by this Agreement and all applicable policies incorporated by reference, including our Privacy Policy. These Terms apply to all visitors, customers, vendors, partners, and contributors. Your continued use of the Site constitutes acceptance of any modifications to these Terms. We may revise this Agreement at our sole discretion by updating this page. It is your responsibility to review it periodically.

NOTICE: THIS AGREEMENT INCLUDES AN ARBITRATION CLAUSE AND CLASS ACTION WAIVER. BY USING THIS SITE, YOU AGREE TO INDIVIDUAL ARBITRATION FOR MOST DISPUTES.

2. Eligibility and Authority

Use of the Site is limited to individuals 18 years or older who are legally competent. By using the Site, you affirm that you meet these requirements. If you use the Site on behalf of an entity, you represent that you are authorized to bind that entity to this Agreement.

3. Intellectual Property Rights

All content on the Site—including text, images, layouts, code, downloadable materials, and trademarks—is the exclusive property of Safe Kids Strong Moms or its licensors, and is protected under U.S. and international copyright and trademark law.

You are granted a limited, non-transferable license to view and use content for personal, non-commercial purposes. Sharing of free educational materials is allowed solely for awareness purposes, provided there is no compensation or modification. All other uses require prior written consent.

4. Acceptable Use Policy

You agree to use the Site in compliance with applicable laws and this Agreement. Prohibited activities include, but are not limited to:

  • Unauthorized automated access or scraping

  • Circumventing security features

  • Posting unlawful, misleading, or harmful content

  • Reverse engineering or modifying the Site

  • Misuse of intellectual property

  • Diverting users to competing platforms

  • Spamming or harvesting data

We reserve the right to suspend or terminate access at our discretion.

5. User Accounts

Some features require you to register for an account. You agree to provide accurate information and keep your credentials secure. You are responsible for all activity that occurs under your account.

6. Product Use and Health Disclaimer

Our products are designed for personal wellness and informational use and are not medical devices. They should be used only as directed and in accordance with all safety instructions. Use by minors should be supervised by a parent or legal guardian, and we recommend consulting a licensed healthcare provider before use.

Safe Kids Strong Moms makes no representations or warranties that any product will prevent disease, mitigate EMF risks, or produce health outcomes. You expressly agree that use of our products is at your sole risk and that Safe Kids Strong Moms is not liable for any claims arising from such use.

7. Privacy Policy and Data Use

Your use of the Site is also governed by our Privacy Policy, which is incorporated into this Agreement by reference. The Privacy Policy explains how we collect, use, and store your information. By using this Site, you consent to those practices.

8. Pricing and Availability

Prices are shown in U.S. Dollars and are subject to change without notice. Product availability is not guaranteed. International orders may be subject to additional customs duties or exchange fees.

9. Orders, Payments, and Chargeback Policy

All orders must be prepaid using a valid payment method. Orders are not binding until accepted and fulfilled. We reserve the right to cancel or refuse any order at our discretion.

Chargebacks: Unauthorized or frivolous chargebacks are prohibited. If you initiate a chargeback in violation of this Agreement, you agree to be responsible for any related fees, collection costs, and legal expenses incurred by Safe Kids Strong Moms in recovering the disputed amount.

10. Taxes

You are responsible for paying any applicable taxes or import duties related to your purchase. We report revenue as required by law.

11. Shipping

We ship within the United States and to select international locations. Risk of loss transfers to you upon delivery to the carrier. You are responsible for any customs duties or delays.

12. Return and Refund Policy

Customized Faraday EMF Shield Bags are not eligible for return. Other products may be returned within 30 days if unused and in original packaging. Return shipping costs are the responsibility of the customer.

13. Account and Billing Information

You must provide complete and current billing and contact information. We may cancel orders if information is inaccurate or unverifiable.

14. No Medical Claims

Nothing on this Site is intended to be medical advice. Our products are not approved to diagnose, treat, cure, or prevent any disease. You should always consult a licensed healthcare provider for medical decisions.

15. Third-Party Links and Content

The Site may contain links to third-party websites. We do not control and are not responsible for their content, privacy practices, or availability. Use of such sites is at your own risk.

16. Errors, Inaccuracies, and Modifications

We may correct errors in product listings, pricing, or availability at any time without notice, even after an order is placed.

17. Term and Termination

This Agreement remains in effect until terminated. We reserve the right to terminate or restrict access at any time without notice or liability.

18. Disclaimer of Warranties and Limitation of Liability

THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. SAFE KIDS STRONG MOMS DISCLAIMS ALL WARRANTIES INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SITE OR PRODUCTS WILL BE ERROR-FREE OR UNINTERRUPTED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAFE KIDS STRONG MOMS SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, PERSONAL INJURY, PROPERTY DAMAGE, OR ATTORNEYS’ FEES, ARISING FROM YOUR USE OF THE SITE OR PRODUCTS.

YOUR SOLE REMEDY FOR DISSATISFACTION IS TO STOP USING THE SITE OR SEEK A REFUND IN ACCORDANCE WITH OUR RETURN POLICY. MAXIMUM LIABILITY, IF ANY, SHALL BE LIMITED TO THE AMOUNT PAID BY YOU FOR THE PRODUCT OR SERVICE IN QUESTION.

19. Governing Law and Dispute Resolution

I. This Agreement shall be governed by the laws of the State of Arizona, U.S.A., without regard to conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

II. Except for small claims or intellectual property disputes, all disputes must be resolved by binding arbitration under the Federal Arbitration Act, administered by the American Arbitration Association (AAA) using one neutral arbitrator. The arbitration will be conducted in English in Arizona, or, at the party's election, by phone, online, or written submission. If the parties cannot agree on an arbitrator within 20 days, the AAA will appoint one.

III. Either party may seek injunctive relief in a court of competent jurisdiction without waiving the right to arbitrate. Arbitration-related documents and awards shall remain confidential unless disclosure is required to enforce legal rights.

IV. Disputes may only be brought in an individual capacity. Class actions and representative claims are prohibited.

V. Any claim must be filed within one (1) year of the purchase giving rise to the claim or it will be permanently barred.

VI. If a claim is not subject to arbitration, it must be brought in the courts of Arizona, U.S.A., and both parties waive objections to venue and jurisdiction.

20. Force Majeure

We are not liable for failure to perform due to events beyond our control, including natural disasters, acts of war, or technology failures.

21. Survival of Terms

Terms related to intellectual property, warranties, limitations of liability, dispute resolution, and indemnity survive termination of this Agreement.

22. Interpretation

This Agreement shall be construed fairly and not against either party as the drafter.

23. Assignment

You may not assign or delegate your rights or obligations under this Agreement without prior written consent. Safe Kids Strong Moms may assign its rights and obligations at its sole discretion.

24. Waiver; Entire Agreement and Integration

No waiver of any term shall be valid unless in writing and signed by the party to be charged. This Agreement constitutes the entire understanding between the parties and supersedes all prior representations or agreements.
